At a Special meeting of the Mayfield Planning Board, Town of Mayfield, Fulton County, New York, held on Tuesday March 7, 2006 at the Mayfield Municipal Building, 28 North School Street at 7:00 pm there were

PRESENT:

Robert Cooper, Board Member

EXCUSED:

Marilyn Salvione, Board Member, John Vadney, Board Member

OTHERS PRESENT: Michael Stewart, Code Enforcement Officer, Kathy Canary Planning Board Clerk.

Chairman Arthur Dahl called the meeting to order at 7:05 pm.

APPROVAL OF MINUTES-A motion was made by Robert Cooper and seconded by Nancy Deitch to approve the minutes of February 15, 2006 as submitted.

Carried 3(three) AYES 0(Zero) NAYS

NEW BUSINESS:

RESCIND PUBLIC HEARING DUNKIN’ DONUTS

Chairman Dahl addressed the issue to rescind the Public Hearing and SEQR review set for March 15, 2006 at 7:30 pm concerning Dunkin’ Donuts.  After conferring with the County Planning Board, Sean Geraghty suggested that we conduct a coordinated SEQR process, which means the scheduled .Public Hearing should be deferred to a later date. Allowing more time would give this board the opportunity to methodically consider this project.  The board received from Gavin Vuillaume, Environmental design consultant for Dunkin’ Donuts, the Environmental Long Form for review. 

PLANNING BOARD ACTION  

A motion was made by Robert Cooper to rescind the decision to hold a Public Hearing on March 15, 2006, seconded by Nancy Deitch. ALL IN FAVOR CARRIED 3(three) AYES 0(zero) NAYS.

LEAD AGENCY FOR DUNKIN’ DONUTS

Discussion was held on being named the Lead Agency for the Dunkin’ Donuts proposal. The other agencies involved are Department of Transportation, Department of Health, Department of Environmental Conservation, and Army Corp of Engineers.  By proposing to be Lead Agency we would have the benefit of the other agencies’ knowledge and comments.  We would also benefit by allowing more time to perform a SEQR review, moving the SEQR review into the month of April.  A letter would be sent to the other agencies proposing we be named Lead Agency.  Sean Geraghty of Fulton County Planning Board will send out packages to the aforementioned agencies.

Nancy Deitch made a motion to propose ourselves as Lead Agency, Robert Cooper seconded. ALL IN FAVOR CARRIED 3(three) AYES 0(zero) NAYS

ZONING REGULATIONS

Under the Town of Mayfield Zoning Law the Planning Board is responsible for recommending to the Town Board any modifications to the Zoning Regulations.  Michael Stewart, Code Enforcement Officer, discussed a number of various laws with his suggestions of change.  A number of these laws were explained with their change.  Further discussions of these laws were tabled and will be addressed at the next meeting.

A letter from Jerry Moore was addressed and will be discussed at the next meeting.

Each member received a copy of the letter for their review.

COORESPONDENCE:

Chairman Dahl received information about an upcoming seminar in Saranac Lake on March 23, and 24, 2006 He offered his regrets due to a prior engagement, but recommended attendance by the other members.

Next meeting will be held March 15, 2006

On motion by Robert Cooper, seconded by Nancy Deitch the meeting was adjourned at 8:05 p.m.  CARRIED 3(three) AYES 0(zero) NAYS
